When a loved one is killed by another’s careless acts, it can be a traumatic and challenging experience for those left behind. In addition to grieving the loss of a family member, survivors may be faced with dire financial consequences, such as paying for medical and funeral expenses and handling their everyday bills. Although a wrongful death lawsuit can’t change the painful past, it may help a family achieve a sense of closure and security to move on in life.
At Glover Law Firm, our Northeastern North Carolina wrongful death attorneys believe in providing compassionate and professional legal assistance to families who have lost someone dear to them in an accident. We work hard to hold the parties who have caused their harm responsible and to make sure they are fully compensated for their losses.

If the deceased victim could have brought a personal injury lawsuit against the party who caused a fatal accident, then the personal representative of the decedent’s estate – usually a spouse or parent – may bring a wrongful death action. This means that wrongful death claims involve issues similar to personal injury actions and arise from the same causes, such as:
- Car accidents,
- Truck accidents,
- Motorcycle accidents,
- Bicycle accidents,
- Reckless driving accidents
- Pedestrian accidents,
- Dog bites,
- Nursing home abuse and neglect cases.
The main difference between a wrongful death and a personal injury claim is the type of damages available to the survivors. In a wrongful death claim, family members may seek to recover compensation for:
- The victim’s medical expenses that were incurred prior to the death
- The victim’s pain and suffering if the victim was conscious of it before death
- Funeral expenses
- The victim’s lost financial support, including educational funds
- Loss of the services, care and assistance of the deceased
- Loss of the victim’s comfort and companionship.
As in a personal injury lawsuit, punitive damages may be awarded where the death was caused by especially egregious misconduct, such as reckless driving. In most cases, punitive damages are capped at $250,000 or three times the amount of actual damages, whichever is greater, but that cap does not apply in cases involving drug- or alcohol-impaired drivers.
